Terms and Conditions
1. The Service
[Your Company Name] provides a platform that utilizes Near Field Communication (NFC) technology to record Proof of Presence. By "tapping" a designated NFC tag with a compatible device, you are creating a digital record of a physical interaction at a specific time and location (a "Tap Event").
2. User Consent & Interaction
Voluntary Action: A "Tap Event" is a deliberate physical act. By performing a tap, you explicitly consent to the transmission of data between your device and our systems.
Data Captured: Each tap may record:
Unique Tag ID and Location.
Timestamp of the interaction.
Device identifiers (to ensure the security of the presence data).
3. Proof of Presence & Accuracy
Verification: You agree that a "Tap" constitutes a verified physical presence. You may not use third-party software or hardware to "spoof" or emulate an NFC tap.
Service Availability: We do not guarantee that NFC tags will be functional in all environments (e.g., areas with high electromagnetic interference or physical damage to tags).
4. Prohibited Conduct
You agree not to:
Tamper with, overwrite, or physically damage any [Your Company Name] NFC tags.
Attempt to reverse-engineer the encryption or data protocols used in the NFC handshake.
Use the service to stalk, track, or monitor individuals without their express consent.
5. Privacy and Data Security
Our collection of "Presence Data" is governed by our Privacy Policy. Because a tap records a "physical moment in time," we treat this data with enhanced security measures.
Note: Unlike GPS tracking, which is passive, NFC data is active. We only record your location when you choose to interact with a tag.
6. Limitation of Liability
[Your Company Name] is not responsible for:
Unauthorized "taps" if your device is lost or stolen.
The failure of a tap to record due to device incompatibility or user error.
Any decisions made by third parties (employers, retailers, etc.) based on the Presence Data recorded.
7. Termination
We reserve the right to deactivate your access to the platform if we detect "synthetic taps" or any attempt to manipulate the integrity of the physical interaction data.
